Terms & Conditions

Last revised: October 31, 2026  |  Policy version: STS-POL-2026-10-31-R2

These Terms and Conditions ("Terms") form part of the booking contract between 1064435 B.C. Ltd., operating as Sea to Sky Expeditions ("Sea to Sky", "STS", "we" or "us") and the person purchasing or participating in a guided trip ("Participant" or "you"). Our business contact address is 4865 Bench Road, Cowichan Bay, BC V0R 1N1, Canada; email info@seatoskyexpeditions.com.

For a direct booking, the accepted contract consists of these Terms, the Booking Policy, the trip-specific itinerary or description identified at checkout, and the booking confirmation recording the selected trip, participants, departure and completion dates, itemized charges, taxes, total price, deposit and remaining payment dates. The transaction-specific booking details are part of the contract. The applicable version is the one disclosed and accepted when the booking contract is entered into, not a later website update.

For an authorized reseller booking, a separate agreement with the reseller may also apply. Nothing in a reseller agreement removes any non-waivable rights that a Participant has against a supplier under applicable law. Participants should confirm who is contracting with them and who handles payment and refunds.

1. Guaranteed Departures

Between 75 and 61 days before departure, Sea to Sky determines whether a scheduled departure can be guaranteed. Our general policy is to guarantee departures with four or more confirmed bookings by 60 days before departure. For departures with fewer than four bookings, we normally cancel the departure with a full refund of sums paid to us for that trip, or offer an alternative that the Participant may accept or decline.

We commit to guides, permits, transport and supplies in advance. A guaranteed departure may still require cancellation or change because of safety, park closures, government directions, severe conditions or other significant operational circumstances; the relevant refund provisions below continue to apply.

2. Reservations, Deposits and Final Payment

A 30% deposit is required to confirm a booking and is generally non-refundable. The remaining balance is due 75 calendar days before departure. Payment of the balance at 75 days does not make it immediately non-refundable: amounts above the deposit remain refundable under the ordinary participant cancellation policy until the 60-day cutoff. At 60 calendar days or fewer before departure, the full trip price is non-refundable if the participant cancels, subject to applicable law.

We intend the interval between the 75-day payment deadline and the 60-day cancellation cutoff to provide an opportunity to reconsider participation, discuss concerns with us and review insurance arrangements. It does not guarantee that an insurer will provide cancellation coverage purchased at that time; coverage terms and purchase deadlines vary.

If a final payment is not received by the 75-day due date, STS may cancel the reservation and retain the deposit under the ordinary cancellation policy, subject to any notice and consumer rights required by applicable law. Missing a payment does not eliminate statutory rights.

Pre-bookings without confirmed departure dates: Where we accept a 30% deposit before a departure date has been confirmed with the relevant park authority, that deposit remains refundable for ten (10) calendar days following confirmation and notification of the departure dates. After that period the ordinary deposit policy applies, subject to applicable law.

Temporary reservation requests: For tours requiring a suitability discussion, STS may temporarily hold an online reservation request for up to 96 hours while discussing the trip's physical requirements and receiving the required booking information and deposit. A temporary hold should not be treated as a guaranteed confirmed place. Any checkout language must accurately reflect how the booking system processes payment and contract acceptance.

3. Trip Price, Additional Costs and Payments

Trip prices are quoted in Canadian dollars (CAD). Before completing a booking, the checkout must identify the selected trip, dates and duration, the itemized price, applicable taxes, any known additional charges, the total price, the deposit payable and remaining balance and due date. Optional equipment rentals, travel to and from the trip, accommodation not specified as included, and other selected extras are additional unless expressly included in the trip description.

We accept Visa, Mastercard, e-transfer and international wire transfer, subject to the payment options actually offered for the booking. If payment is arranged in another currency, the exchange rate and any banking or transfer fees will be communicated before payment where reasonably determinable. Third-party banks and card providers may impose additional charges.

The agreed trip price and included services are those shown in the accepted booking confirmation. We may alter prices advertised for future bookings; we do not unilaterally increase a confirmed booking price. If a material change to a confirmed booking is proposed, the Participant will be notified and offered available remedies, including a refund where required or agreed.

4. Participant Cancellation and Refunds

  • More than 60 calendar days before departure: If a Participant cancels, the 30% booking deposit is generally non-refundable, but other amounts paid toward the Trip price are refundable, subject to the limited pre-booking exception and rights under applicable law.
  • 60 calendar days or fewer before departure: If a Participant cancels, the full Trip price is non-refundable under our ordinary commercial policy, subject to rights and remedies that cannot legally be excluded.
  • Once the Trip has commenced - no refund for unused services: STS does not issue refunds or credits for unused portions of a Trip because a Participant does not enjoy or is dissatisfied with the experience, disagrees or does not get along with another guest or guide, voluntarily leaves, becomes ill or injured, cannot continue safely, is evacuated, or because the Trip is reasonably changed, shortened or interrupted due to safety, weather, environmental or other legitimate operational circumstances. This ordinary no-refund rule applies regardless of whether the interruption or early departure was requested by the Participant or required for legitimate safety or operational reasons. It is always subject to rights and remedies that cannot legally be excluded under applicable law. It does not remove a remedy to which a Participant is legally entitled because STS fails to fulfil an enforceable contractual or legal obligation.

For ordinary cancellation or rescheduling requests, contact us promptly at info@seatoskyexpeditions.com and retain written confirmation. Statutory cancellation notices may be given by any method permitted by law. Email is our preferred administrative method, not the only legally valid method for a statutory cancellation.

5. Cancellation or Interruption by Sea to Sky

Sea to Sky may need to cancel or reschedule a Trip before departure because of insufficient numbers, park closures, dangerous conditions, government restrictions, lack of guide availability, logistical problems or other operational circumstances. If STS cancels the booked departure before the Trip begins, we refund in full the payments we have received for that Trip, including the deposit, unless the Participant chooses and accepts an offered alternative. Independent costs such as airfare, visas and equipment are not normally reimbursed by STS, except where applicable law requires otherwise.

Once the Trip has begun, guides may change, shorten, suspend or terminate activities when reasonably necessary for safety or legitimate operational reasons. Our ordinary policy is no refund or credit for an unused part of a Trip after it commences, whether the participant leaves voluntarily, must be evacuated, or a legitimate safety or operational circumstance causes early termination. These provisions do not override any right to cancellation, repayment, damages or another remedy that cannot be excluded under applicable law, including where STS breaches an enforceable legal or contractual duty.

Any offered alternative departure or materially different itinerary requires the Participant's affirmative agreement; silence is not acceptance of a new booking contract.

6. Travel Insurance — Strongly Recommended, Not Required

STS strongly recommends purchasing appropriate trip cancellation, trip interruption, emergency medical, emergency evacuation and repatriation insurance, including coverage appropriate to remote wilderness travel and any cross-border travel. Insurance is voluntary; we do not require purchase or proof of coverage. STS does not provide insurance to Participants.

Participants should review exclusions, pre-existing condition restrictions, geography, evacuation benefits and the timing of purchase directly with their insurer. Without suitable coverage, a Participant may personally bear trip fees that are non-refundable and other medical, transport and travel expenses.

7. Evacuation Transportation and Emergency Assistance Charges

Illness, injury, inability to continue safely, or other circumstances—including events beyond a Participant's control—may require an early departure or evacuation. Whenever STS provides or arranges chargeable evacuation transportation, the following STS charges apply regardless of the cause of evacuation:

Evacuation transportation provided or arranged by Sea to Sky Fee (CAD)
Ground evacuation by road — Dawson City or Bowron Lakes $600
Ground evacuation by road — all other adventures $350
Air evacuation by floatplane or helicopter (aircraft cost included) $1,000

Air evacuation: The CAD $1,000 fee includes the floatplane or helicopter transportation used for that evacuation; the aircraft cost is not added again as a separate STS charge.

Public emergency services: STS does not charge its own transportation fee when the evacuation transportation is fulfilled solely by publicly funded Search and Rescue or government ambulance services. A public agency may charge its own ambulance or other fees. If STS separately provides or arranges additional chargeable evacuation transportation, the applicable STS fee may also apply.

Other costs: Medical treatment, hospital care, third-party services unrelated to the aircraft service included above, accommodation, personal travel changes and onward transportation are not included in the STS fee schedule. Such expenses may amount to thousands of dollars or more. Participants may be responsible for applicable charges not paid by publicly funded services or insurance. STS strongly recommends coverage suited to these risks.

These charges are disclosed at checkout and apply as described whether the evacuation is requested by the Participant or initiated for safety or medical reasons. Nothing here authorizes an additional STS fee for transportation fulfilled exclusively by publicly funded rescue or ambulance services.

8. Preparation, Health Information and Required Forms

Participants must review the trip's physical demands, prepare appropriately, give accurate and complete information relevant to safe participation, and notify STS of material changes before or during the Trip. STS may reasonably request a physician's assessment where relevant to participation.

Important - separate Release of Claims, Waiver of Liability and Assumption of Risk: Our wilderness activities involve risks of injury, illness, death, loss and damage. Every adult Participant is required to review and individually sign STS's separate liability waiver before departure; a parent or guardian may be required to complete appropriate documentation for a minor, subject to applicable law and legal review. The waiver is legally significant: subject to its exact language and applicable law, it seeks to release STS and the other parties named in it from specified claims, including claims arising from their own negligence, and may substantially limit the Participant's ability to sue or recover compensation for injury, death, loss or damage.

The full waiver must be made available for review before the booking is completed, and the checkout disclosure must clearly draw attention to its legal effect, including the negligence release. Each Participant signs the waiver separately before participation; a purchaser's checkout acknowledgement is not itself a signature on behalf of other Participants. If a person declines or fails to complete the required waiver or other necessary participation documents, they may not participate, subject to applicable law; the ordinary cancellation/refund policy may apply. The waiver is not used to add undisclosed commercial fees or retroactively change the accepted booking refund policy.

Participants must also complete the separate medical/preferences form by the communicated deadline, normally 60 days before departure. Failure to give materially accurate safety information or complete required documentation may lead to denial of departure or evacuation, subject to applicable law and accommodation obligations. Cancellation and evacuation provisions above govern applicable financial consequences.

Medical and other personal information is handled in accordance with our Privacy Policy and applicable privacy requirements. Any marketing photo/likeness permission should be requested separately and voluntarily.

9. Participant Responsibilities

  • Bring appropriate clothing and equipment and follow the pre-trip information provided.
  • Observe reasonable health and hygiene practices, and respect other guests, guides, local cultures and the natural environment, including appropriate Leave No Trace practices.
  • Follow reasonable safety instructions, disclose relevant concerns to guides, and avoid substances or conduct that impair safe participation.
  • Complete and sign the required risk acknowledgement and liability waiver and provide accurate medical and emergency contact information.

10. Changes to Itinerary; Guide Authority

STS makes reasonable efforts to provide the published trip itinerary. Because remote wilderness travel depends on weather, water, trail conditions, participant abilities and other changing factors, guides may reasonably alter routes, camps, transportation, leaders, activities or timing where necessary for safety or practicable operation.

Guides have authority to make on-trip safety decisions, including stopping an activity or arranging for a Participant to leave where their behaviour, health or capabilities pose a serious concern. Participants must follow reasonable safety instructions. The refund and evacuation provisions above apply, subject to all non-excludable consumer and other legal rights. These clauses do not authorize changes unrelated to legitimate operational needs or remove remedies that the law requires.

11. Trip Objectives and Limitations

STS strives to provide the agreed guided wilderness experience but cannot guarantee specific wildlife sightings, weather, trail conditions or the achievement of a particular optional objective. A change to an objective does not itself determine whether a refund is legally due; applicable law and the contract as a whole govern.

12. Third-Party Bookings, Refund Recipients and Notices

When a booking is made through an authorized reseller, the reseller may have separate payment and cancellation procedures. STS generally remits any commercial refund to the original paying party, but this arrangement does not restrict consumer remedies required by law. Resellers should disclose STS's applicable supplier terms before the guest commits to the trip.

Correspondence and ordinary booking requests may be sent to info@seatoskyexpeditions.com or by mail to 4865 Bench Road, Cowichan Bay, BC V0R 1N1, Canada. Statutory cancellation notices may be sent by any method permitted by law and are effective as provided by law.

13. Governing Law and Consumer Rights

These Terms are interpreted under the laws of British Columbia and applicable Canadian law, without limiting any mandatory rights or legally available forums. These Terms do not compel arbitration, limit a Participant's lawful ability to publish a review, or prohibit lawful collective legal proceedings.

Non-excludable rights and remedies prevail: The non-refundable deposit, pre-departure cancellation charges and no-refund-after-departure provisions state our ordinary commercial refund policy. They apply only to the extent permitted by law. Nothing in these Terms or in a separate liability waiver waives or restricts any right, protection, statutory cancellation entitlement, repayment obligation or remedy that cannot legally be excluded under applicable law, including the Business Practices and Consumer Protection Act. Nor do these provisions exempt STS from a legal remedy arising from a breach of enforceable contractual or legal duties where such a remedy cannot lawfully be excluded.

14. Entire Booking Agreement, Version and Changes

The booking contract comprises these Terms, the Booking Policy, the accepted trip-specific description and itemized booking confirmation, and any subsequent written change affirmatively agreed by both parties. The applicable version is the version disclosed and accepted at the time of booking. Later website changes do not automatically amend existing contracts.

Separate liability release: The full liability waiver must be available to review at checkout, with a prominent advance warning of its significance, including claims arising from negligence. The separate waiver will be signed before participation by each appropriate signatory. Checkout acknowledgment that the waiver has been disclosed does not itself execute the subsequent release. The release addresses risks, liability and claims, and is not intended to create new undisclosed commercial charges or retroactively vary the agreed booking payment and refund provisions. The final wording, scope of releasees, signature process and arrangements for minors require legal approval.

15. Severability

If any provision is determined to be invalid or unenforceable, the remaining provisions continue to apply to the extent allowed by law.

16. Contact and Acceptance

Questions or notices may be directed to info@seatoskyexpeditions.com; mailing address: 4865 Bench Road, Cowichan Bay, BC V0R 1N1, Canada.

At checkout, the Participant must have the opportunity to access, review and retain the entire booking agreement, must receive conspicuous notice and access to the full separate liability waiver, and must expressly acknowledge both the commercial contract and the waiver-signing requirement before completing the booking. The completed booking confirmation should record the accepted version, the Participant's name, contract date, specific trip and price information, and should be emailed with a retainable copy of these Terms and the Booking Policy.
